1. Introduction

Welcome to Azina365. The App is owned and operated by Ciphercom Ltd. By accessing or using the App (mobile or web), you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

Azina365 is a digital management platform for SACCOs, Chamas, and Welfare Groups. The App provides tools to manage savings, contributions, loans, member records, statements, and reporting. The App is a technology facilitator only — it does not itself provide loans, take deposits, or offer banking services.

3. Eligibility

Use is restricted to verified members of organizations (SACCOs, chamas, welfare groups) that are onboarded to Azina365. Users must be at least 18 years old (or the age of majority in their jurisdiction).

4. Account Registration and Access

Your organization’s administrator provisions access to the App. You are responsible for maintaining the confidentiality of your credentials and for all activities performed under your account. Notify your administrator or support immediately if you suspect unauthorized access.

5. Use of the App

• You must provide accurate and current information when requested.
• The App must only be used for lawful, group-related financial activities.
• Do not attempt to reverse-engineer, modify, copy, or distribute the App or any of its components.
• Any misuse, fraudulent activity, or breach of applicable laws may result in suspension or termination of access.

6. Financial Transactions

Azina365 facilitates the recording and processing of transactions for onboarded organizations. The App itself does not grant credit, issue loans directly, or accept deposits. Transactions using integrations such as M-Pesa are performed under authorization of the member and the member's organization and are subject to the organization’s rules and applicable third-party terms.

7. Data Privacy & Security

Ciphercom Ltd is committed to protecting user data. Azina365 complies with applicable data protection laws, including the Kenya Data Protection Act, 2019. Data is encrypted in transit and at rest. We do not sell personal data. Please review our Privacy Policy for full details on collection, use, retention, and user rights.

8. Intellectual Property

All intellectual property rights in the App, its design, text, images, and code are owned by Ciphercom Ltd or its licensors. You may not use Ciphercom’s trademarks, logos, or copyrighted material without prior written permission.

9. Limitation of Liability

To the fullest extent permitted by law, Ciphercom Ltd shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of data, or business interruption arising from or related to the use of (or inability to use) the App.

10. Suspension and Termination

We may suspend or terminate access to the App for users or organizations that violate these Terms, engage in fraudulent activity, or for legal/regulatory reasons. Termination of an organization’s subscription will restrict access for that organization’s members.

11. Amendments

Ciphercom Ltd may update these Terms from time to time. When changes are material, we will notify organization administrators or post a prominent notice. Continued use after changes indicates acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya.
